GENERAL TERMS AND CONDITIONS
These terms and conditions apply to the sales of tickets in PayU system accessible through the website www.timeforchopin.eu. Each customer, not later than upon expressing their intention to enter into a remote agreement with Time for Chopin, has the opportunity to familiarize themselves with and accept these terms and conditions and is informed about their rights and obligations.
Tickets in Time for Chopin system are sold by:

CONTRACTING AND PURCHASING PROCEDURE
Tickets are sold in PayU payment system through the pages in timeforchopin.eu domain, and at Time for Chopin point of sale in the Old Gallery of the Association of Polish Art Photographers at the address: pl. Zamkowy 8, 00-277 Warsaw – prior to concerts. Tickets may also be purchased in eBilet system via the website www.ebilet.pl in accordance with the terms and conditions available on this website. Tickets can also be purchased from authorized distributors, which include tourist information centers, selected tour operators and certain hotels.
Tickets purchased at a point of sale will be deemed to be sold upon paying for them at the operator of a point of sale of Time for Chopin system.
When ordering Tickets and paying for them, the Customer must exercise due diligence. Entering incorrect data, e.g. the transfer amount or the payer’s data, thus preventing the Customer identification, may result in the refusal to accept the payment and in the transaction cancellation.
Purchasing tickets in timeforchopin.eu online service
When the Customer selects an event from the offer of timeforchopin.eu, the type of tickets and the number of seats, they must fill in the form with their personal data and choose the way of payment. Ways of payment: payment in PayU system and payment at a point of sale.
If the Customer selects payment in PayU system, after clicking “Pay for order” box, they will be redirected to PayU website where they may choose the payment method. Payment methods are as follows: (i) payment from PayU account or using VISA or MasterCard card, or (ii) online wire transfers made through e-banking systems. Traditional bank transfers and BLIK payments are also available. The Customer may decide to cancel the transaction by pressing “Rezygnuj” (“Cancel”) button.
By selecting the payment method and making the payment, the Customer expresses their intention to enter into a remote agreement concerning the event chosen by them. Then, to the e-mail address provided by the Customer in the booking process, they will be sent the initial acknowledgment of ticket(s) booking or purchase. Time for Chopin will also receive the notification about the booking and save it in the system with a Client ID (e.g. last name) and the information whether the payment will be made prior to the concert or it has already been made through PayU system, and then will send the final acknowledgment of ticket(s) booking or purchase to the Customer’s email address. From this moment, the booking will be binding for Time for Chopin.
In the case of the payment for ticket(s) using online wire transfer or a card through PayU system, the Customer will be sent the acknowledgment of the payment registration in Time for Chopin system when Time for Chopin receives the confirmation of the Customer’s payment from PayU system.
In the case of the payment for ticket(s) using a traditional bank transfer, the Customer will be sent via e-mail the acknowledgment of the payment registration in the system when the payment for their booking is booked in PayU system and when the respective information is sent to Time for Chopin.
If the Customer has chosen to make the payment just before the concert, they should purchase ticket(s) providing their ID not later than 20 minutes before the start of the concert. Time for Chopin cannot guarantee to the Customers who arrive to buy ticket(s) later than 20 minutes before the start of the concert that their booking will still be valid.

A ticket is a document entitling its holder to attend the concert for which it was issued. By purchasing a ticket, the Customer accepts the terms and conditions concerning the participation in the concert. A single ticket is issued to its bearer and gives the right to attend the concert to one person. A ticket is checked once upon entering the concert hall and it may not be reused.
Seats in the concert hall are not numbered and Customers are free to choose their seats from among those seats that are currently available and that are not pre-booked. The seats of the Customers who booked their seats earlier will bear their last names or other IDs.
Decisions concerning changes of the Performer or of a recital or concert program may result from unforeseeable circumstances and, in such a case, Time for Chopin will make refunds to those Customers who request them. The Concert Organizer’s personnel may decide not to let the Customer in to attend the Concert or order them to leave the Concert only in justified cases in an effort to ensure proper conditions of the participation in the event to other participants in the Concert.
Prices and price categories
Tickets for concerts organized by Time for Chopin are available in various price categories. Discount tickets are available for students and young people. Detailed offer is presented on Time for Chopin website.
Student tickets are available to persons with valid student ID cards.
Young Person tickets are available to people under 19 years of age.
If the Customer wishes to make a complaint related to any inconvenience (e.g. poor visibility due to the placement of television cameras), the Customer may demand that the Organizer ensures to them appropriate conditions of the participation in the event (e.g. by changing their seat). In each case, the Customer may make a complaint, which will be handled by the Organizer according to the procedure provided for in these terms and conditions.
Collection of tickets purchased in the online system
The ticket office is open one hour before the start of the concert.
The Customer who receives the booking confirmation after the purchase in the online system should present the received printout before the concert. If they do not have such a printout, it will not be a problem, as the personnel can check the booking in the system. Once the paid booking is checked, the Customer will receive the ticket and must find their seat in the concert hall. When the Customer has chosen to pay before the concert, they make the payment, receive the ticket and find their seat.
When a ticket has been purchased in Time for Chopin system or from an agent, the Customer should come to the concert with the purchased ticket, voucher or other proof of ticket purchase. If Time for Chopin does not receive any information about this booking earlier, the Customer will chose their seat from among non-occupied seats available at the concert hall.
PAYMENT METHOD AND PERIOD
Depending on the Customer’s choice, the following types of payment are available: payment card, online wire transfer, traditional bank transfer and cash payment. In the case of booking tickets via Time for Chopin Telephone Service, the Customer may pay at the ticket office before the concert by cash or by payment card. We accept Visa (credit, debit, business) cards and MasterCard (credit, debit and Maestro) cards. In the case of purchasing tickets in other points of sale, payments are made in accordance with the rules applicable in such points.
In the case of the payment with a payment card, following the acceptance of the booking made through Time for Chopin system, after pressing “Pay for order” button, the Customer will be redirected to PayU website. Before entering the payment card number, the Customer must make sure that they have been redirected to the website of PayU online system and that the connection is encrypted (the website address should start with “https://”). PayU S.A. is responsible for making and securing payment card transactions on PayU websites in accordance with its terms and conditions. When making the payment with a payment card, the Customer must select the card type (types of accepted payment cards: Visa (credit, debit, business) card and MasterCard (credit, debit and Maestro) card), enter the 16-digit card number, the card expiration date and CVV2/CVC2 code located on the back of the card.
Online wire transfer
Following the acceptance of the booking made through Time for Chopin system and the selection of online wire transfer, and following the selection of the bank maintaining the account from which the Customer wants to make the payment, the Customer will be redirected to the transactional online system of the selected bank. Before logging in, the Customer must make sure that they have been redirected to the selected bank’s website and that the connection is encrypted (the website address should start with “https://”). PayU S.A. is responsible for making and securing online transfer transactions on PayU websites in accordance with its terms and conditions.
Traditional bank transfer
If the Customer chooses payment by traditional bank transfer, the payment should be made as soon as possible. We will wait 72 hours from the booking time for the booking of the transfer in PayU account. After this period, the booking will be canceled and tickets will be returned to the general pool of tickets available for sale. In the case of the cancellation of tickets booking in Time for Chopin sales system due to the payment for tickets after the specified period (72 hours), Time for Chopin will not be liable to the Customer for the Customer’s inability to make the purchase.

The Customer Service Department is open every day from 10.00 am until 6.00 pm CET.
The costs of using means of remote communication in order to enter into an agreement in Time for Chopin sales system do not exceed the fees charged usually for using such means of communication.
When the Customer selects the option of receiving the VAT invoice on the ticket booking tab, the invoice will be delivered to the Customer in accordance with the terms and within the time limits resulting from the Polish Value Added Tax (VAT) Act. In the case when Time for Chopin receives the full payment for ticket(s), the VAT invoice shall be issued to the Customer not later than 10 days following the date of the payment receipt by Time for Chopin. The VAT invoice is sent by standard mail to the address provided by the Customer in the booking process. On the ticket booking tab, the Customer, when selecting the delivery option for the VAT invoice, may select the consent to receive the VAT invoice in an electronic form. If such consent is selected, the VAT invoice is sent in PDF format to the email address provided by the Customer in the booking process.
If the Customer purchases the ticket just before the concert, the VAT invoice may be issued immediately in the form of a printout from the cash register.
ADMISSION AND PARTICIPATION
The Concert Organizer may refuse to let the Customer in to attend the concert if they violate any terms and conditions of the event or conditions established by it. The Organizer, the owner or the manager of the venue in which the event takes place may carry out security checks from time to time to ensure the security for Customers.
When the Customer is late, the Organizer will make efforts to let such a person in to attend the event during a break; however, such admission is not guaranteed at all times.
Unauthorized use of photographic or recording equipment is prohibited. Laser pens, mobile phones, dogs (except for guide dogs for disabled people) and Customers’ own food and beverages may also be prohibited.
RETURNS OF TICKETS / BOOKINGS
Agreement withdrawal rules
The Customer entering into an agreement in Time for Chopin ticket selling system outside an enterprise’s premises or remotely, pursuant to Article 38 Section 12 of the Polish Consumer Rights Act of May 30, 2014 (Polish Journal of Laws of 2014 item 827), has the right to withdraw from the agreement without giving any reasons in accordance with the terms provided in Article 27 of the aforementioned Act.
Time for Chopin provides for the possibility of returning tickets in accordance with the following principles.
Refund in the case of a concert cancellation
The Customers who bought tickets at the ticket office prior to a canceled concert will receive a refund for their tickets at the ticket office in cash or in the form of a refund payment to the payment card account, depending on how they purchased their tickets.
The refund for a ticket purchased in Time for Chopin electronic distribution system will be made upon receipt of the Customer’s message sent to the e-mail address: email@example.com with the acknowledgment of the booking that was paid for attached to the message. In the case of the payment by online wire transfer, the refund is made to the bank account number from which the payment for the ticket was made. In the case of the payment with a payment card, the refund will be made to the account of the card used to pay for the ticket. Time for Chopin will notify the Customer by e-mail of the transfer of the money to be refunded and will immediately (but not later than within 14 days) make a refund for purchased tickets.
If tickets are purchased from an agent, the tickets along with the completed return form should be returned to the ticket office, which will make the refund in cash or immediately (but not later than within 14 days) will make the payment to the bank account provided by the Customer on the form.
The Organizer may propose a different concert date to the Customer and the Customer may accept it, keeping the tickets purchased for the canceled concert. The Customer may refuse to agree to attend the concert on a different date.
Refund in the case of changing the concert program
In rare cases, due to unforeseeable circumstances, the performer and the concert program may need to be revised. In such a case, the Customer may refuse to attend the concert and request a refund for the ticket. In this case, the refund procedure described above for the concert cancellation will apply.
The return and refund for Tickets or their exchange in cases other than those referred to in items 8.2.1. and 8.2.2. above is possible unconditionally, if the conditions provided for in Article 27 of the Polish Consumer Rights Act of May 30, 2014 are met, and in the cases when the Concert Organizer deems the reason for the Customer’s inability to attend the concert to be important.
To return the Ticket and get a refund, the Customer should send a message to the e-mail address: firstname.lastname@example.org with the information about the intention to return the Ticket and attaching the booking acknowledgment received earlier and the proof of payment for the ticket.
Complaints related to purchases of tickets in Time for Chopin ticket distribution system may be submitted electronically to the e-mail address: email@example.com or in writing by registered mail to the address of Time for Chopin sp. z o.o. sp. k.: ul. Korczyńska 6A/40, 02-934 Warsaw.
Time for Chopin will respond to any complaint immediately, not later than within 14 days from the date of submitting a complaint.
When the Customer deems the handling of their complaint to be unsatisfactory, they may request assistance from consumer and municipal organizations or the county consumer ombudsman. The claims assertion procedure is described on the website of the Polish Office of Competition and Consumer Protection (UOKiK) at www.uokik.gov.pl.
The Customer who is a consumer may also use the EU’s ODR online dispute resolution platform at here.
Within the meaning of these Terms & Conditions, “Force Majeure” means any event beyond the control of Time for Chopin, including, but not limited to, unforeseeable circumstances, war, insurrection, commotion, riots, acts of terrorism, fire, explosion, flood, theft of vital equipment, intentional damage, cyber attack, strike, lock-out, adverse weather conditions, injunctive relief, national defense requirements, acts and regulations of central and local government bodies. Time for Chopin will not be liable to the Customer for the failure to meet any obligations under these Terms & Conditions in so far as this is due to Force Majeure.
The data controller of your personal data is Time for Chopin Sp. z o.o. s. k. based in Warsaw (02-934) at the address: ul. Korczyńska 6A/40. Your personal data will be processed only to perform the ticket sale/purchase agreement and for archiving purposes. Personal data are provided voluntarily. You have the right to gain access to them, correct and supplement them.
The personal data provided by you will not be disclosed to any other entities.
These Terms & Conditions will become effective as of May 10, 2017.
