General terms and conditions

These terms and conditions apply to the sale of tickets in the purchase transaction system available via the website www.timeforchopin.eu. Each customer, no later than at the moment of expressing his/her will to be bound by a remote agreement with Time for Chopin, has the opportunity to familiarize themselves with and accept these terms and conditions and is informed about his/her rights and obligations.

Tickets in Time for Chopin system are sold by:

Contracting and purchasing procedure

Tickets are sold on the PayU or Paynow transaction systems via websites in the timeforchopin.eu domain, and also at the Time for Chopin point of sale in the Stara Galeria of the Association of Polish Art Photographers pl. Zamkowy 8, 00-277 Warsaw – before the concert. Tickets can also be purchased from authorized distributors, which include tourist information points, selected tour operators and some hotels.

Tickets purchased at a point of sale will be deemed to be sold upon paying for them at the operator of a point of sale of Time for Chopin system.

When ordering Tickets and making payments for them, the Customer is obliged to exercise due diligence. Entering incorrect data, e.g. the transfer amount or the payer’s data, which makes it impossible to identify the Customer, may result in refusal to book the payment and cancellation of the transaction.

Purchasing tickets in timeforchopin.eu online service

After selecting an event from the offer of the timeforchopin.eu website, the type of tickets and the number of seats, one must fill in the form with personal data. The payment method is payment via PayU or Paynow, to be chosen by the customer.

By clicking the “Pay for the order” field, the customer is redirected to the PayU or Paynow website, where he/she can choose the payment method. The payment methods are: (i) payment by credit or debit card or (ii) online transfers via banking websites. Also available: classic bank transfer and blik. The customer has the option of resigning from the transaction by pressing the “Cancel” button.

If Paynow is selected, the entity providing online payment services in the field of card payments is Blue Media S.A. and in the case of PayU – PayU S.A. Available payment methods: Payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro.

By selecting the payment method and making the payment, the Customer expresses his will to be bound by a remote agreement for the event of his choice. Then, a ticket purchase confirmation is sent to the e-mail address provided by the Customer in the booking process. Time for Chopin also receives information about the reservation made and saves it in the system with the Customer’s ID (e.g. surname). The reservation becomes binding for Time for Chopin from now on.

In the case of payment for the tickets by online transfer or by card via PayU or Paynow, confirmation of payment registration in the Time for Chopin system is sent to the Customer after Time for Chopin receives confirmation from PayU or Paynow that the Customer has made the payment.

In the case of payment for tickets by a classic bank transfer, confirmation of payment registration in the system is sent to the Customer’s e-mail address after the payment for the reservation has been booked in the PayU or Paynow system and after sending the information to Time for Chopin.

Tickets

General rules

A ticket is a document entitling its holder to attend the concert for which it was issued. By purchasing a ticket, the Customer accepts the terms and conditions regarding the participation in the concert. A single ticket is issued to its bearer and gives the right to attend the concert to one person. A ticket is checked once upon entering the concert hall and it may not be reused.

Seats in the concert hall are not numbered and Customers are free to choose seats from those that are currently free and not reserved. The first two rows are reserved for customers with premium tickets. Customers who have previously made a reservation will find seats designated for them with their name or other identifier.

Decisions concerning changes of the Performer or of a recital or concert program may result from unforeseeable circumstances and, in such a case, Time for Chopin will make refunds to those Customers who request it. Time for Chopin may also offer customers to listen to the concert at a different time. The Concert Organizer’s personnel may decide not to let the Customer in to attend the Concert or order them to leave the Concert only in justified cases in an effort to ensure proper conditions of the participation in the event to other participants in the Concert.

Prices and price categories

Tickets in various price categories are available for Concerts organized by Time for Chopin. For premium ticket holders, the 1st or 2nd row, or even seats on the stage, are reserved. In the standard category, discounted tickets for students and youth are offered. The detailed offer is presented on the Time for Chopin website.

Student tickets are available to persons with valid student ID cards.

In the event of a complaint due to inconvenience (e.g. poor visibility due to the setting of television cameras), the Customer may demand that the Organizer provide him with appropriate conditions for participation in the event (e.g. by changing the seat). In any case, the Customer may submit a complaint, which will be considered by the Organizer according to the procedure provided for in these terms and conditions.

Collection of tickets purchased in the online system

The ticket office is open one hour before the start of the concert.

A customer who has received a booking confirmation after making a purchase on the website should present the received voucher before the concert. The lack of such a voucher is not an obstacle, because the staff can check the reservation in the system. After checking the paid reservation, the Customer receives a ticket and finds a place for him/her in the concert hall. When the ticket was purchased in the Time for Chopin system or from an intermediary, the Customer should come with the purchased ticket, voucher or other proof of purchase of the ticket. If Time for Chopin has not previously received information about this reservation, the Customer takes a free seat of his choice in the concert hall.

Payment method and period

General rules

Depending on the Customer’s choice, the following types of payment are available: payment card, online wire transfer, traditional bank transfer and cash payment. In the case of booking tickets via Time for Chopin Telephone Service, the Customer may pay at the ticket office before the concert by cash or by payment card. We accept Visa (credit, debit, business) cards and MasterCard (credit, debit and Maestro) cards. In the case of purchasing tickets in other points of sale, payments are made in accordance with the rules applicable in such points.

Payment card

In the case of the payment with a payment card, following the acceptance of the booking made through Time for Chopin system, after pressing “Pay for order” button, the Customer will be redirected to PayU or Paynow website. Before entering the payment card number, the Customer must make sure that they have been redirected to the website of PayU or Paynow online system and that the connection is encrypted (the website address should start with “https://”). PayU S.A. is responsible for making and securing payment card transactions on PayU websites in accordance with its terms and conditions. Blue Media S.A. is responsible for making and securing payment card transactions on Paynow websites in accordance with its terms and conditions. When making the payment with a payment card, the Customer must select the card type (types of accepted payment cards: Visa (credit, debit, business) card and MasterCard (credit, debit and Maestro) card), enter the 16-digit card number, the card expiration date and CVV2/CVC2 code located on the back of the card.

Online wire transfer

After confirming the reservation made via the Time for Chopin transactional service and selecting the online transfer payment option, and after selecting the bank that maintains the account from which the Customer wants to make the payment, the Customer will be redirected to the transaction website of the selected bank. Before logging in, please make sure that the redirection has taken place correctly and that the Customer is on the website of the selected bank and that the connection is encrypted (the website address should start with: “https://”). PayU S.A. is responsible for the execution and security of e-transfer transactions carried out on the PayU website. in accordance with its regulations. Blue Media S.A. is responsible for the execution and security of transactions carried out on Paynow websites in accordance with its regulations.

Traditional bank transfer

If the Customer chooses the option of payment by traditional transfer, the payment should be made as soon as possible. We wait 72 hours from the moment of making the reservation for the transfer to be credited to the PayU or Paynow account. After this date, the reservation is cancelled and the tickets return to the general pool of tickets for sale. In the event of cancellation of the booking of tickets within the Time for Chopin sales system due to payment for tickets after the specified time (72 hours), Time for Chopin will not be liable to the Customer for his/her inability to purchase tickets.

The Customer Service Department is open every day from 10.00 am until 6.00 pm CET.

The costs of using means of remote communication in order to enter into an agreement in Time for Chopin sales system do not exceed the fees charged usually for using such means of communication.

Invoice

On the ticket booking card, the Customer has the option of placing an annotation requesting a VAT invoice. In this case, the full name of the buyer, address and tax identification number should also be provided. After Time for Chopin receives the full payment for the ticket, a VAT invoice is issued to the Customer no later than 10 days after the day on which the payment was received by Time for Chopin. The VAT invoice is sent in pdf format to the e-mail address provided by the Customer in the booking process. The customer can also ask for an invoice even if he/she has not put the appropriate annotation on the booking card. In this case, however, it is possible to issue an invoice before the end of the month in which the Customer participated in the concert.

If a ticket is purchased before the concert, a VAT invoice can be issued immediately in the form of a printout from the cash register.

Admission and participation

The concert organizer is entitled to refuse admission to customers who grossly violate the provisions of the regulations, in particular in a way that makes it difficult for other customers to participate in the event. The organizer, owner or manager of the facility where the event takes place may occasionally carry out security checks to ensure the safety of customers.

In the event of delay, the Organizer will make efforts to ensure that latecomers are admitted during the break to the event, but admission may not always be guaranteed.

Unauthorized use of photographic or recording equipment is prohibited. Laser pens, mobile phones, dogs (other than guide dogs for people with disabilities) and customers’ own food and beverages may also be prohibited.

Returns of tickets / bookings

Agreement withdrawal rules

A customer concluding a contract in the Time for Chopin ticket sales system outside the business premises or remotely has the right to withdraw from the contract without giving a reason within 14 days.

Returns

Time for Chopin provides for the possibility of returning tickets in accordance with the following principles.

Refund in the case of a concert cancellation

The Customers who bought tickets at the ticket office prior to a cancelled concert will receive a refund for their tickets at the ticket office in cash or in the form of a refund payment to the payment card account, depending on how they purchased their tickets.

The refund for a ticket purchased via the Time for Chopin electronic distribution system will be made after receiving a message from the Customer to the e-mail address: biuro@timeforchopin.eu containing a booking confirmation with payment. In the case of payment by online transfer, the funds are returned to the bank account number from which the payment for the ticket was made. In the case of payment with a payment card, the funds will be returned to the account of the card used to pay for the ticket. Time for Chopin will notify the Customer by e-mail about the transfer of funds to be returned and will immediately (but not later than within 14 days) refund the amount due for the purchased tickets.

In the case of purchase from an agent (e.g. GetYourGuide, Viator, Musement, eBilet, etc.), the Customer should contact the appropriate agent with a request for a refund for the purchased tickets. Such a return is usually not possible once the concert has already taken place.

The Organizer may propose a different concert date to the Customer and the Customer may accept it, keeping the tickets purchased for the cancelled concert. The Customer may refuse to agree to attend the concert on a different date.

Refund in the case of changing the concert program

In rare cases, due to unforeseeable circumstances, the performer and the concert program may need to be revised. In such a case, the Customer may refuse to attend the concert and request a refund for the ticket. In this case, the refund procedure described above for the concert cancellation will apply.

Other returns

The return and refund for Tickets or their exchange in cases other than those referred to in items above is possible unconditionally, if the conditions provided for in Article 27 of the Polish Consumer Rights Act of May 30, 2014 are met, and in the cases when the Concert Organizer deems the reason for the Customer’s inability to attend the concert to be important.

To return the Ticket and get a refund, the Customer should send a message to the e-mail address: biuro@timeforchopin.eu with the information about the intention to return the Ticket and attaching the booking acknowledgment received earlier and the proof of payment for the ticket.

Complaints

Complaints related to purchases of tickets in Time for Chopin ticket distribution system may be submitted electronically to the e-mail address: biuro@timeforchopin.eu or in writing by registered mail to the address of Time for Chopin sp. z o.o. sp. k.: ul. Korczyńska 6A/40, 02-934 Warsaw.

Time for Chopin will respond to the complaint immediately, no later than within 14 days from the date of its receipt.

If the Customer finds the way of considering the complaint unsatisfactory, he may ask for help from consumer organizations and municipal or poviat consumer ombudsmen. Detailed information on pursuing claims is available on the website of the Office of Competition and Consumer Protection: www.uokik.gov.pl.

Liability

Within the meaning of these Terms & Conditions, “Force Majeure” means any event beyond the control of Time for Chopin, including, but not limited to, unforeseeable circumstances, war, insurrection, commotion, riots, acts of terrorism, fire, explosion, flood, theft of vital equipment, intentional damage, cyber attack, strike, lock-out, adverse weather conditions, injunctive relief, national defense requirements, acts and regulations of central and local government bodies. Time for Chopin will not be liable to the Customer for the failure to meet any obligations under these Terms & Conditions in so far as this is due to Force Majeure.

Personal data

The administrator of your personal data is Time for Chopin Ltd LP with its registered office in 02-934 Warsaw, ul. Korczyńska 6A/40. The website www.timeforchopin.eu does not use cookies. Your personal data will be processed only for the purpose of implementing the ticket purchase agreement, as well as for archiving purposes for the period necessary to consider possible complaints. Personal data is provided voluntarily. You have the right to access them, as well as to correct and supplement them.

The personal data provided by you will not be disclosed to any other entities.

These Terms and Conditions will become effective as of November 1st, 2022.
